Govt Moves to Amend PECA to Combat Fake News: Legislation Expected Soon

The federal government is poised to amend the Prevention of Electronic Crimes Act (PECA) to address the growing concerns surrounding “fake news” and misinformation.
This legislation is expected to be presented in parliament soon, with discussions and negotiations currently underway among political partners.
As reported, the decision comes after the federal cabinet recently approved shifting PECA’s oversight from the Ministry of Information Technology to the Ministry of Interior, requiring amendments to the Rules of Business 1973.
Key Features of the Proposed Amendments
- Formation of a New Authority: The amendments will establish a Digital Rights Protection Authority (DRPA), which will have the power to regulate online content, block access to social media, and prosecute individuals disseminating false information.
- Stricter Penalties: The proposed changes include severe penalties for those found guilty of spreading fake news. Offenders could face up to five years in prison or fines reaching Rs1 million. The law aims to penalize anyone who intentionally shares false information that could incite fear or unrest.
- Broadening of Complaint Mechanisms: Under the new provisions, any individual will be able to file complaints regarding fake news, expanding the scope beyond just aggrieved parties. This change has raised concerns about potential misuse and the chilling effect on free speech.
