IHC reserves verdict on PTI plea challenging Imran Khan’s arrest warrant

A district and sessions court restored on Monday Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan's non-bailable arrest warrant in the Toshakhana case.

The Islamabad High Court reserved its verdict on a PTI plea seeking the cancellation of the arrest warrant against Imran Khan in the Toshakhana case on Wednesday afternoon.

Chairman PTI’s lawyer Khawaja Haris, while filing the petition, requested the hearing today.

Chief Justice Amir Farooq conducted a hearing during which lawyers Khawaja Haris, Ali Bukhari, Ali Gohar and others appeared in the court on behalf of Imran Khan.

During the preliminary hearing, Islamabad High Court Chief Justice Aamir Farooq said that this court had heard the petition and given instructions, but it is a pity what happened.

Khawaja Haris said before the court that you should listen to us, and we will satisfy the court according to the law.

The IHC Chief Justice inquired that this court had given relief earlier, but what happened to these court orders, what could be the consequences of not implementing the court orders?

The Chief Justice said that there are objections to the application before me, and he also directed Imran Khan’s lawyers to remove the objections.

Khawaja Haris said in the court that the situation in Lahore is in front of you.

Justice Aamir Farooq remarked that what is happening in your own doing, this court had given an honourable way but it was not followed.

When the hearing resumed on the warrant cancellation application, the Chief Justice said that there are minor objections to your application.

The Chief Justice further said that I am removing the objection of biometrics and signatures, and after removing the remaining objections, we will hear it.

Barrister Gauhar, the lawyer of Chairman Tehreek-e-Insaf said that the hearing on the warrant cancellation application will be held after the division bench, during which we will remove the objections from our application.

Later, the court staff said that the objections to the petition filed by Imran Khan have been removed and the petition has also been numbered, the hearing will be held today.

Today’s hearing:

When the hearing started, Imran Khan’s lawyer Khawaja Haris said he only need 5 minutes as he wanted to tell the court something, adding “we have challenged the order of March 13.”

He said that earlier the court had suspended the issuance of the warrant by the trial court and directed Imran Khan to appear before the court on March 13. Imran Khan was at home that day.

Khawaja Haris further said that the court had said that if the petitioner did not appear in the court, the arrest warrant would be reinstated, but on March 13, we had filed a request for exemption from attendance in the trial court, which was dismissed and the trial court issued the arrest warrant. what

The lawyer said that we told the trial court that it is not necessary to issue an arrest warrant, there is a difference between criminal cases and bailable cases.

The Chief Justice said that the trial court’s warrant was in the field and still is.

Khawaja Harich said that we had asked the trial court not to issue an arrest warrant until a decision was taken on whether the application was admissible or not.

He said that the complaint was not filed under the Election Commission Act, under Section 6 of the Act, the commission itself can file a complaint, and the complaint has been filed on behalf of the Secretary Election Commission.

Khawaja Haris, citing various laws, said that the complaint was filed wrongly, and the concerned officer was not authorized to file the complaint.

While giving arguments, he further said that the Election Commission has to register a criminal case within the specified days.

The Election Commission has not yet told the trial court whether the case was filed on time or not and the Secretary Election Commission does not have the authority to refer the criminal case to the trial court.

The court inquired that there has been no debate on the admissibility of the application yet.
