Justice Mansoor Ali Shah Criticizes Chief Justice Qazi Faez Isa’s Leadership in Strongly Worded Letter

Justice Mansoor Ali Shah has publicly criticized Chief Justice Qazi Faez Isa in a strongly-worded letter, detailing his reasons for not attending the full-court reference held in honour of Isa.
In this letter, dated October 25, 2024, Justice Shah expressed profound discontent with Isa’s leadership, accusing him of failing to protect the judiciary from external pressures and influences.
In his letter, Justice Shah stated, “I in good conscience cannot stand at a Reference for such a Chief Justice,” highlighting his ethical stance against endorsing what he sees as a compromised leadership.
Justice Shah described Justice Isa as complacent and indifferent, likening him to an “ostrich” with his head in the sand. He argued that Isa did not stand firm against interference, which he believes undermined the judiciary’s role as a check on power.
He also criticized Isa for displaying a “blatant disregard” for judicial collegiality and failing to engage in necessary dialogue.
Shah emphasized that true judicial leadership requires consensus-building, which he claims Isa has consistently neglected.
Justice Shah pointed out that celebrating Isa’s tenure would send a troubling message about the integrity of the judiciary. He characterized Isa’s term as marked by “pettiness” and “vindictiveness,” suggesting that such behaviour should not be honoured.
This letter comes at a time of significant tension within Pakistan’s judiciary, particularly following recent amendments to the Supreme Court Practice and Procedure Act that have been controversial among legal circles. Justice Mansoor’s decision to abstain from the reference is seen as part of a broader critique of the current judicial administration under Chief Justice Isa, who is set to retire shortly.
