Reference against Justice Waqar to be filed in Supreme Judicial Council after research

A reference against Chief Justice of Peshawar High Court (PHC) Justice Waqar Seth on his controversial observation regarding the Musharraf’s verdict has not been filed in Supreme Judicial Council (SJC), the law ministry spokesperson said on Saturday.

Research related to the reference was being conducted and the attorney general had returned from his trip to Turkey on Saturday, the spokesperson said.

The government decided on Thursday to take legal action against Peshawar High Court’s Chief Justice Waqar Ahmed Seth for his notorious observation in the detailed verdict in high treason case that sentenced former president Pervez Musharraf to death for imposing a state of emergency on November 3, 2007.

Justice Waqar authored the paragraph 66 of the verdict, directing the law enforcement agencies to arrest Musharraf and ordered that if he was found dead, drag his body to the D-Chowk in Islamabad and hang it for three days.

The observation sparked outrage among the people,  government, political and legal analysts for the insensitive observation against the former military chief.

“I do not understand what needed the judge had to give such an observation,” he said during a press conference.

“By giving such an observation, Justice Seth has proven that he is mentally unfit. I would like to request the Supreme Court to stop the judge from working,” he stated.
