Supreme Court reinstates grade 1 to 7 employees sacked during 1996 to 1999

The Supreme Court of Pakistan on Friday has announced the reserved judgment in a case involving the reinstatement of more than 6,000 dismissed employees of 38 federal agencies.

Justice Mansoor Ali Shah disagreed with the decision of the Supreme Court in the case of reinstatement of dismissed employees by a majority of four to one.

The Supreme Court in its judgment said that the law of 2010 is unconstitutional and the court has reinstated the employees who were sacked from 1996 to 1999.

As per the judgment, the employees working in BPS 1 to 7 will be restored and their case will be heard under Article 184/3. However, the employees working in grades 8 and above will have to pass the departmental examination.

The SC made it clear that for those employees who were fired on charges of corruption and misconduct, their sacking would remain intact.

The verdict further explained that those who were recruited between a period of 1996 and 1999 and did not pass the test, would have to clear the exam. But those employees who were hired after taking the exam in that period, are not required to pass the exam again, the judgment added.

Yesterday, a five-member bench of the apex court headed by Justice Umar Bandial heard a review appeal filed by the government against the decision of dismissal of employees on December 14 and directed Attorney General Khalid Javed Khan to give arguments on the Second Employees Act.
