SC bench dissolved again as Justice Mandokhail recuses himself from hearing poll case

Justice Jamal Khan Mandokhail said he was not consulted despite being a member of the bench

SC bench has been dissolved again as Justice Mandokhail recuses himself from hearing the poll case on Friday.

Now a three-member bench headed by Chief Justice of Pakistan Umar Ata Bandial resumed the hearing of the Punjab and Khyber Pakhtunkhwa election delay case. 

The other two members of the bench include Justice Ijaz Ul Ahsan and Justice Munib Akhtar.

Moments after Justice Mandokhail refused to become part of the SC bench, Chief Justice of Pakistan Umar Ata Bandial reconstituted the bench for the third time.

Justice Aminuddin Khan was the first member to recuse himself. 

In the hearing of the three-member bench, Chief Justice Umar Atta Bandial rejected the Attorney General’s request to form a full court for the time being and remarked that he will make some meetings after the hearing.

While apologizing for joining the bench, Justice Jamal Khan Mandukhel said that the order was awaited after the decision of Justice Aminuddin Khan to leave the bench.

He further said that I received the court order at home yesterday, and I have written a separate note on the order.

Justice Jamal Khan Mandukhel further said that I was a member of the bench but I was not consulted, so I think that I am a ‘misfit’ on the bench, all fellow judges are bound by the constitution.

The Chief Justice thanked Justice Jamal Mandukhel and stopped him from talking.

The Chief Justice said that whatever decision will be taken regarding the formation of the bench will be informed in the court after some time.

The new bench will decide in a while, CJP added.
